Terms & Conditions

Please read these Terms carefully before hiring any vehicle from AucWell's electric Vehicle. These Terms form a legally binding agreement between you and AucWell Automotive Group Pvt. Ltd., registered in Nepal, operating Nepal's premier EV hire service.

1. Acceptance of Terms

By accessing AucWell's website, mobile application, or hiring any vehicle from our electric Vehicle, you ("Customer", "you") agree to be legally bound by these Terms and Conditions ("Terms"). These Terms constitute a binding contract between you and AucWell Automotive Group Pvt. Ltd., a company registered under the laws of Nepal.

If you do not agree to these Terms in full, you must immediately cease using our services. AucWell reserves the right to amend these Terms at any time with 14 days' notice. Continued use after notice constitutes acceptance.

⚠️ These Terms are governed by the laws of Nepal. By using our services, you consent to the exclusive jurisdiction of the courts of Kathmandu, Bagmati Province, Nepal.

2. Eligibility & Licensing

To hire a vehicle from AucWell, you must:

Age Requirement: Be at least 18 years of age. Drivers under 25 may be subject to a young driver surcharge.

Valid Driving Licence: Hold a valid Nepalese driving licence (issued by DoTM) or an International Driving Permit (IDP) recognised under the 1949 Geneva Convention, relevant to the vehicle category hired.

Licence Validity: Your licence must be valid for the entire hire period. Expired licences will result in immediate cancellation without refund.

Medical Fitness: You must be medically fit to drive and not suffering from any condition that impairs your ability to operate a motor vehicle safely.

Identity Verification: You must present original identification: Nepali Citizenship Certificate, Passport, or National ID card. Photocopies are not accepted.

Authorised Drivers Only: Only drivers listed on the hire agreement may operate the vehicle. Unauthorised drivers void all insurance cover.

3. Booking, Payment & Confirmation

Bookings may be made via our website, mobile app, or at any AucWell service counter in Nepal.

Pricing Currency: All prices are quoted in Nepalese Rupees (NPR). Foreign customers may pay in USD or EUR at the prevailing Nepal Rastra Bank exchange rate.

Payment Methods: We accept eSewa, Khalti, IME Pay, ConnectIPS, major debit/credit cards (Visa, Mastercard), and bank transfers to our NIC Asia Bank account.

Security Deposit: A refundable security deposit of NPR 10,000–50,000 (depending on vehicle category) is required at the time of pickup. This is returned within 7 business days of vehicle return, subject to no damage or outstanding charges.

Booking Confirmation: Your booking is confirmed only upon receipt of payment and issuance of a booking reference number via email or SMS.

VAT: All charges are inclusive of 13% Value Added Tax (VAT) as required by the Inland Revenue Department of Nepal.

4. Cancellation & Refund Policy

The following cancellation schedule applies to all bookings unless a separate corporate agreement states otherwise:

Refunds are processed to the original payment method. eSewa/Khalti refunds typically settle within 3–5 business days; bank transfers within 7 business days.

5. Vehicle Use & Restrictions

You agree to use AucWell vehicles responsibly and in compliance with all applicable Nepalese traffic laws. The following restrictions apply:

Driving under the influence of alcohol, drugs, or any substance impairing judgment

Crossing international borders without prior written approval from AucWell

Using the vehicle for commercial ride-sharing (Pathao, InDrive, taxis) without a separate commercial agreement

Off-road or unpaved mountain track driving beyond designated routes

βœ•

Towing or pushing other vehicles

βœ•

Carrying more passengers than the vehicle's registered seating capacity

Transporting hazardous, flammable, or illegal materials

Participating in any race, rally, or competitive driving event

Allowing unlisted drivers to operate the vehicle

Tampering with or disabling any telematics or GPS device

Violation of any restriction above may result in immediate termination of the hire, full forfeiture of the security deposit, and recovery of the vehicle at your expense.

6. Electric Vehicle & Charging Policy

AucWell operates Nepal's largest EV hire Vehicle. The following policies apply specifically to our electric vehicles:

Charge at Handover: All vehicles are delivered with a minimum 80% state of charge (SoC). You are responsible for returning the vehicle with at least 20% SoC. A low-charge return fee of NPR 500 applies for every 10% below 20%.

Approved Charging Stations: You may charge at any Nepal Electricity Authority (NEA) approved public charging station, AucWell partner hubs, or a standard 16A home outlet with the supplied EVSE cable. Do not use unapproved fast chargers without AucWell approval.

Charging Costs: Public charging costs are borne by the customer unless a prepaid charging package was included in the hire agreement. Retain all charging receipts for reimbursement claims.

Range Planning: You are responsible for planning routes within the vehicle's rated range. AucWell is not liable for costs incurred due to insufficient charge planning, including roadside assistance callouts for flat batteries.

Battery Care: Do not charge to 100% or allow battery to drain to 0% repeatedly. Extreme charging behaviour causing accelerated battery degradation may incur a battery health penalty deducted from the security deposit.

7. Insurance & Liability

All AucWell vehicles carry third-party insurance as mandated by the Vehicle and Transport Management Act, 2049 (Nepal). The following insurance framework applies:

Third-Party Liability: Included in all hire rates. Covers bodily injury and property damage to third parties as per Nepal Motor Insurance guidelines.

Collision Damage Waiver (CDW): Optional add-on reducing your liability for vehicle damage to a defined excess amount. CDW does not cover theft, vandalism, or damage caused by prohibited use.

Customer Excess: Without CDW, you are liable for the first NPR 25,000–75,000 of damage costs (vehicle category dependent). With CDW, excess reduces to NPR 5,000.

Exclusions: Insurance does not cover: damage caused while under the influence, driving by unauthorised persons, off-road damage, international incidents, or deliberate damage.

Personal Accident Insurance: Available as an optional add-on covering medical expenses and personal injury for the driver and passengers during the hire period.

8. Accidents, Damage & Breakdown

In the event of an accident, damage, theft, or breakdown, you must:

Immediately call AucWell's 24/7 emergency line: +977-1-XXXXXXX

Contact Nepal Police (100) if there are injuries or third-party damage

Do not move the vehicle unless it poses a safety hazard on the road

Photograph all damage, involved vehicles, licence plates, and the scene

Obtain a police report (with case number) within 24 hours for any accident involving third parties

Do not admit liability or make payments to third parties on behalf of AucWell

Complete an AucWell Incident Report Form within 24 hours of any incident

Failure to report an incident promptly may void insurance cover and result in full damage costs being charged to you.

9. Traffic Violations & Fines

You are solely responsible for all traffic fines, penalties, and violations incurred during the hire period, including but not limited to:

Speeding fines issued by Nepal Traffic Police

Parking violations in Kathmandu Metropolitan City or other municipalities

Lane violations, signal jumping, or use of mobile phone while driving

Overloading or carrying prohibited goods

Failure to carry required documents (licence, vehicle registration, insurance)

If AucWell receives a fine or penalty notice on your behalf after the hire period, we will charge the fine amount plus an administration fee of NPR 500 to your registered payment method.

10. Vehicle Return

Vehicles must be returned:

On Time: At the agreed date, time, and location. Late returns exceeding 1 hour will be charged at 1.5Γ— the standard daily rate for each additional day or part thereof.

Clean Condition: Reasonably clean. Excessive dirt, staining, pet hair, or odour may incur a cleaning fee of NPR 500–3,000 depending on severity.

Fuel/Charge Level: With at least 20% battery charge. See Section 6 for low-charge return fees.

With All Accessories: Including EVSE charging cable, vehicle registration document, insurance certificate, and any AucWell-supplied accessories. Replacement costs apply for missing items.

Damage Inspection: A walk-around inspection will be conducted at return. Any new damage not documented at pickup will be attributed to the hire period.

11. Telematics & Monitoring

All AucWell vehicles are equipped with GPS and telematics devices that continuously monitor vehicle location, speed, battery status, and driving behaviour during the hire period.

By hiring a vehicle, you expressly consent to:

Real-time GPS tracking throughout the hire period

Recording of speed, acceleration, braking, and cornering data

Remote vehicle immobilisation in the event of theft, non-payment, or use in a prohibited zone

Geo-fencing alerts if the vehicle enters a restricted area without prior approval

Data sharing with law enforcement upon lawful request

Tampering with, disabling, or covering any telematics device is strictly prohibited and will result in immediate termination of hire, full security deposit forfeiture, and potential criminal liability.

12. Limitation of Liability

To the maximum extent permitted by Nepal law, AucWell's total liability to you in connection with any hire shall not exceed the total hire charges paid by you for the relevant booking.

AucWell is not liable for:

Loss of earnings, business interruption, or consequential losses arising from vehicle unavailability

Delays caused by road conditions, natural disasters, political disruptions, bandhs, or Acts of God

Personal property left in or stolen from the vehicle

Losses arising from your breach of these Terms

Breakdown costs resulting from misuse, negligence, or prohibited use

⚠️ Nothing in these Terms limits AucWell's liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation, as prohibited under Nepal's Consumer Protection Act, 2075.

13. Force Majeure

AucWell shall not be held liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters (floods, earthquakes), government-imposed restrictions, nationwide strikes or bandhs, acts of terrorism, pandemic-related restrictions, or power grid failures affecting EV charging infrastructure. In such cases, AucWell will endeavour to provide a full refund or alternative vehicle at the earliest practical opportunity.

14. Intellectual Property

All content on AucWell's website and mobile application β€” including the AucWell name, logo, vehicle images, pricing tools, booking engine, and written content β€” is the exclusive intellectual property of AucWell Automotive Group Pvt. Ltd. and is protected under Nepal's Copyright Act, 2059. You may not reproduce, distribute, or commercially exploit any AucWell content without prior written permission.

15. Governing Law & Dispute Resolution

These Terms are governed exclusively by the laws of the Federal Democratic Republic of Nepal. Any dispute arising out of or relating to these Terms shall be resolved as follows:

Step 1 β€” Negotiation: The parties shall attempt to resolve the dispute amicably within 30 days of written notice.

Step 2 β€” Mediation: If negotiation fails, the parties agree to non-binding mediation under the Mediation Act, 2068 (Nepal).

Step 3 β€” Arbitration / Court: Unresolved disputes shall be subject to the exclusive jurisdiction of the District Court, Kathmandu, Nepal.
